212.267.0200 Depending on your situation, the court has the discretion to award maintenance (alimony or palimony) to you, which will result in you receiving a money payment to you from the other spouse, either in a lump sum or in payments over a period of time. Such payments are usually awarded to provide income to the dependant spouse. The three types of maintenance awarded are permanent, rehabilitative, and to provide restitution. Permanent maintenance requires a showing of a need of support, and may be reviewed upon changed circumstances of the party. Rehabilitative maintenance is ordered for a limited period of time and is designed for the former spouse to obtain academic or vocational training enabling him or her to become self-supporting. Often, while one spouse works, the other attends school. Support given to one spouse while the other attended school may be repaid through temporary restitutional maintenance.
In determining whether to grant maintenance, the judge will review the length of marriage, the age and health of the parties, parties’ conduct during marriage, sources of income and occupations of the respective parties, assets and debts of the parties, the potential for future income and assets, education and vocational skills of a spouse and his or her employability, and any special needs of the parties.
